Terms of Service

1. Overview This website is operated by Northern Territory Consumables. Throughout the site, the terms “we”, “us” and “our” refer to Northern Territory Consumables. By purchasing from us, you agree to be bound by the following terms and conditions.

2. Inspection and Defects (Clause 11.1) The Customer must inspect the Goods on delivery and must, within seven (7) days of delivery, notify Northern Territory Consumables in writing of any evident defect/damage, shortage in quantity, or failure to comply with the description or quote. Failure to notify within this timeframe may limit your claim for "evident" damage, subject to your statutory rights under the Australian Consumer Law (ACL).

3. Consumer Guarantees (ACL) Nothing in these terms purports to modify or exclude the "Non-Excluded Guarantees" under the Competition and Consumer Act 2010. If you are a "Consumer" as defined by the CCA:

  • Our liability for a breach of a guarantee is limited to (at our election) replacing the goods, repairing the goods, or refunding the cost of the goods.

  • In the event we cannot replace a defective item, we reserve the right to issue a full refund.

4. Commercial and Second-Hand Goods

  • B2B Sales: If the Customer is not a "Consumer" within the meaning of the CCA, our liability is limited to the value of any express warranty provided or the warranty provided by the manufacturer.

  • Second-Hand Goods: Customers acknowledge that second-hand goods are sold with all faults disclosed or observable. To the extent permitted by law, no warranty is given as to the suitability for a specific purpose beyond the item's described condition.

5. Returns and Restocking Fees

  • Change of Mind: We are not required to provide a refund for a change of mind. However, if we choose to accept a non-defective return, a handling fee of 15% of the value of the returned goods plus freight costs will apply.

  • Condition: All returns must be in as close a condition to that in which they were delivered as possible.

6. Limitations of Liability Northern Territory Consumables shall not be liable for any defect or damage caused by:

  • Improper storage or maintenance of consumables (e.g., exposure to NT heat/humidity).

  • Using the goods for a purpose other than their design.

  • Continued use of a product after a defect becomes apparent.

  • Fair wear and tear, accidents, or "Acts of God."

7. Governing Law These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the Northern Territory, Australia.
